Champion Textiles Wins Rs. 7.75 Crore in Coimbatore Dispute

A Coimbatore tribunal has awarded Champion Textiles Rs. 7.75 crore in a property dispute with JMJ Housing Ltd., following a breach of a Joint Development Agreement.

Coimbatore: Champion Textiles Ltd. has emerged victorious in a significant property dispute against JMJ Housing Ltd., with an arbitral tribunal awarding a compensation of Rs. 7.75 crore. This decision stems from a disagreement over a Joint Development Agreement tied to a residential project located in Coimbatore, as per an award issued on October 12, 2026.

The sole arbitration for this case, identified as Arb. O.P. (Com. Div.) No. 394 of 2024, was presided over by Justice T. Ravindran, a respected former Judge of the Madras High Court.

The conflict arose from a Joint Development Agreement executed on January 19, 2022, concerning land in Pattanam village, aimed at developing residential properties.

Champion Textiles, led by Managing Director V.R.S. Natarajan, engaged with JMJ Housing Ltd., represented by its director Wilson P. Thomas, to carry out the development work as per mutually established terms.

However, the relationship soured as discrepancies emerged regarding construction responsibilities, as well as issues related to the transfer of property plots.

Champion Textiles accused JMJ Housing of illegally transferring certain plots to third parties, breaching the agreed terms and the General Power of Attorney. The company also highlighted that the necessary composite agreements were missing for some property transactions.

In refutation, JMJ Housing asserted that they had managed significant preparatory activities and expenditures related to the development.

Judgment of the tribunal emphasized breaches.

After a thorough examination of evidence, including documents and witness testimonies, the tribunal ruled in favor of Champion Textiles based on the key contractual violations.

The arbitral award addressed the developer’s failures regarding their obligations under the Joint Development Agreement, particularly focusing on the disputed property transactions.

The tribunal ordered the annulment of these transactions, declaring them inconsistent with the pre-established contractual terms.

As part of the financial compensation outlined in the ruling, JMJ Housing Ltd. and its director must pay Champion Textiles Rs. 6.75 crore, to bear an interest rate of 18 percent per annum starting from March 13, 2025, until the sum is fully settled.

An additional Rs. 1 crore, also accruing interest at 18 percent per annum from the date of the award, further boosted the overall compensation to Rs. 7.75 crore, excluding other costs.

As significant relief, the award additionally calls for the cancellation of 10 specific sale deeds linked to the disputed land.

The tribunal ordered that JMJ Housing and related parties provide vacant possession of the described property to Champion Textiles within one month of the ruling.

This comprehensive direction forms part of the tribunal’s solution following its conclusions regarding breaches of the development agreement and contested transfers of property.

The arbitration proceedings showcased a complex interplay of conflicting claims rooted in the parties’ contractual obligations. Champion Textiles sought remedies including the cancellation of disputed transactions and a restoration of possession along with monetary compensation, while the respondents contested the claims.

The tribunal’s ruling underscores the necessity for compliance with contractual frameworks and outlines the parties’ responsibilities in real estate development.

The award signed on October 12, 2026, now awaits implementation, with its legal standing set apart from the obligations indicated in the judgment.
